Labor benefits are the payments that an employer must make to the worker when the employment relationship ends. The Dominican Labor Code (Law 16-92) regulates which apply based on the exit reason. The four main ones are notice, severance (assistance), vacation, and Christmas bonus.
Advance notice that must be given by whoever breaks the contract. If the employer does not notify, they must pay the worker the corresponding days in cash (art. 76).
Economic assistance for years worked. It is only paid in termination or unjustified dismissal. It is one of the highest payments for employees with several years (art. 80).
14 or 18 paid days for each year worked, proportional if the fiscal year was not completed. They are always paid, regardless of the exit reason (art. 177).
1/12 of the salaries received in the calendar year (January to December). Also known as "Christmas salary" or "13th salary" (art. 219).

For all calculations, the ordinary daily wage is used, which is obtained by dividing the monthly salary by 23.83 (average working days of the month, according to Dominican labor jurisprudence).

Note: Vacation and the Christmas bonus are ALWAYS paid proportionally to the time worked, regardless of the exit reason.
Actions to claim labor rights expire after three months from the termination of the contract (art. 704 of the Labor Code). If more than 3 months have passed without claiming, you lose the right to sue.
The employer has 10 business days from termination to pay you your benefits. If they do not pay within that period, they must add one day's salary for each day of delay (art. 86).
Labor benefits (severance, notice, compensation) are exempt from income tax in RD. The Christmas bonus is also tax-exempt up to the amount of the minimum wage. Vacation taken as cash (not as days off) is subject to income tax as ordinary salary.
You must file a formal complaint at the nearest Local Representation of the Ministry of Labor. If mediation fails, you can sue in the Labor Court. The action expires in 3 months, so act quickly.
The Labor Code establishes that the rights to notice and severance arise after 3 months of continuous work. Before that, you are only entitled to proportional vacation and Christmas bonus.
We do not include it in this calculator because it depends on the net profits of the company (art. 223), which vary each year. The company is required to distribute 10% of profits, a maximum of 45 or 60 days of salary depending on years of service. Ask your employer what you are entitled to for this concept.
Termination is when one party (employer or employee) ends the contract without cause, giving notice. Dismissal is when the employer terminates citing a fault of the employee. If the cause is proven in court, it is justified dismissal; if not, it becomes unjustified dismissal and they must pay all benefits plus compensation.
